1. Acceptance of Terms

By accessing or using the BirthChart website (birthchart.app) and subscribing to our email reading service (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may modify these Terms at any time. We will notify you of material changes via email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Entertainment Disclaimer

This section is critically important. Please read it carefully.

BirthChart provides astrological readings, horoscopes, natal chart interpretations, transit analyses, and related content (collectively, "Readings"). All Readings are provided strictly for entertainment and personal reflection purposes only.

By using the Service, you acknowledge and agree that:

• Readings are based on astrological interpretations and are not scientifically validated predictions of future events.
• Readings are not a substitute for professional advice of any kind, including but not limited to medical, psychological, psychiatric, financial, investment, legal, or relationship advice.
• You should not make important life decisions based solely on astrological readings.
• BirthChart makes no guarantees about the accuracy, completeness, or reliability of any Reading.
• Any actions you take based on information provided in Readings are at your own risk and discretion.
• If you are experiencing a medical emergency, mental health crisis, or any other serious situation, you should immediately contact appropriate professional services or emergency services.

3. Eligibility

You must be at least 16 years old to use the Service. By subscribing, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into these Terms. If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account & Subscription

4.1 Account Registration

To use the Service, you must provide accurate and complete information, including your email address and birth data (date, time, and location of birth). You are responsible for maintaining the accuracy of this information and the security of your account.

4.2 Subscription Plans

BirthChart offers the following subscription plans:

• Founder: $9.99/month — Daily sun sign readings, weekly transit overview, monthly forecast.
• Ascendant: $19.99/month — All Founder features plus rising/moon sign readings, transit alerts, 12-house analysis, and more.
• Birth Chart Consultation: $49.99 one-time — Comprehensive natal chart analysis delivered as PDF and audio recording.

Annual plans are available at a 20% discount when billed yearly.

4.3 Billing & Payment

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually) until you cancel. You agree to provide a valid payment method and to keep it current.

Subscription fees are charged in advance at the beginning of each billing cycle. The one-time Birth Chart Consultation fee is charged at the time of purchase.

4.4 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price increase via email. Price changes will take effect at the start of your next billing cycle following the notice period. If you do not agree with a price change, you may cancel before it takes effect.

4.5 Cancellation

You may cancel your subscription at any time through the Stripe customer portal or by contacting hello@birthchart.app. Upon cancellation:

• You will continue to receive readings through the end of your current billing period.
• No partial refunds are provided for unused portions of a billing period.
• Your birth data will be retained for 30 days after your subscription ends, then permanently deleted.

4.6 Refunds

Subscription fees are generally non-refundable. However, if you experience a significant service disruption (e.g., failure to receive readings for more than 3 consecutive scheduled delivery days), you may request a prorated refund by contacting us. One-time purchases (Birth Chart Consultation) are non-refundable once the deliverable has been sent.

5. Intellectual Property

All content provided through the Service, including but not limited to reading text, email designs, website content, graphics, logos, and software, is the intellectual property of BirthChart and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from the Service without our prior written consent. You may share brief excerpts of your personal readings on social media for personal, non-commercial purposes, provided you credit BirthChart.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Share your account credentials with others or allow others to access your account.
• Attempt to reverse-engineer, decompile, or extract the source code of any part of the Service.
• Use automated tools (bots, scrapers) to access the Service.
• Redistribute, resell, or commercially exploit Readings or any Service content.
• Provide false birth data with the intent to receive readings for another person without their consent.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIRTHCHART AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service.
• Any decisions made or actions taken based on Readings.
• Unauthorized access to or alteration of your data.
• Any interruption or cessation of the Service.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy or reliability of any Reading or other content provided through the Service.

9. Indemnification

You agree to indemnify and hold harmless BirthChart and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association.

For EU/UK residents: Nothing in these Terms affects your statutory rights under applicable consumer protection laws. You may bring claims in the courts of your country of residence.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BirthChart regarding the Service and supersede all prior agreements and understandings.
